General Terms and Conditions (GTC) of CareVisionCompany GmbH
1. Scope
1.1. These General Terms and Conditions (GTC) apply to all business relationships between CareVisionCompany GmbH (hereinafter referred to as “CVC”) and its customers. CVC is headquartered at Theodor-Heuss-Straße 38, 61118 Bad Vilbel.
1.2. Any deviating, conflicting, or supplementary GTC of the customer shall not become part of the contract, even if known, unless their applicability is expressly agreed to in writing.
2. Subject Matter of the Contract
2.1. CVC places foreign Pflegefachkraf with Krankenhäuser as well as nursing and care homes.
2.2. Placement is carried out on the basis of the customer’s individual requirements and the qualifications of the Pflegefachkraf.
3. Conclusion of Contract
3.1. The contract between CVC and the customer is concluded upon CVC’s written confirmation of the placement agreement.
3.2. Offers made by CVC are subject to change and non-binding.
4. Obligations of CVC
4.1. CVC undertakes to place suitable Pflegefachkraf in accordance with the customer’s agreed requirements.
4.2. CVC ensures that the placed Pflegefachkraf have the required qualifications and authorizations.
5. Obligations of the Customer
5.1. The customer undertakes to provide CVC with all necessary information and documents required for the placement of the Pflegefachkraf.
5.2. The customer is obliged to employ the placed Pflegefachkraf in accordance with statutory provisions and the agreed terms and conditions.
6. Remuneration
6.1. Remuneration for CVC’s placement services is based on the currently valid price list or the individually agreed terms and conditions.
6.2. Payments must be made within 10 days of invoicing without deductions. 7. Termination
7.1. This recruitment contract may be terminated by the client at any time by giving 14 days’ notice.
7.2. In the event of termination, the client shall only incur the fee costs for placement activities whose due period has already been reached or placement activities that have demonstrably commenced.
7.3. If an employment contract is concluded between the client and a candidate provided by CVC within 6 months after termination of the placement contract, the placement fee shall nevertheless become due in full.
8. Data Protection
8.1. Pursuant to Section 298 SGB II, the contracting parties are obliged to treat applicants’ documents and information confidentially. This obligation shall continue to apply even after termination of the contract.
8.2. Upon request, the client must return documents provided by CVC or, in the case of electronic transmission, delete them immediately. This does not apply to documents of an applicant with whom the client has concluded a contract.
8.3. CVC processes the customer’s personal data and the
placed Pflegefachkraf exclusively within the scope of statutory provisions.
8.4. Further information on data protection is contained in CVC’s Privacy Policy.
9. Liability
9.1. CVC shall be liable only for intent and gross negligence. In the event of slight
negligence, CVC shall be liable only in the event of a breach of material contractual obligations.
9.2. Liability is limited to the damage typically foreseeable.
10. Final Provisions
10.1. Amendments and supplements to these GTC must be made in writing.
10.2. Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
10.3. The law of the Federal Republic of Germany shall apply. The place of jurisdiction is CVC’s registered office.
