General Terms and Conditions (GTC)

1. Scope
1.1 These General Terms and Conditions (GTC) apply to all business relationships between CareVisionCompany GmbH (hereinafter “CVC”) and its clients.
1.2 Clients are, in particular, Krankenhäuser, care facilities, outpatient care services, and other employers who commission CVC with the placement of international Pflegefachkraf.
1.3 Deviating terms and conditions of the client shall not apply unless CVC expressly agrees to their validity in writing.
2. Subject Matter of the Contract
2.1 CVC places qualified international Pflegefachkraf in healthcare and nursing facilities in Deutschland.
2.2 Placement services may include, in particular:
- Selection of suitable candidates,
- Coordination of the placement process,
- Support with recognition procedures,
- Support with visa and entry procedures,
- Support until Arbeitsaufnahme.
2.3 There is no entitlement to the placement of a specific number of candidates.
3. Cooperation with Partners
3.1 CVC works with cooperation partners both domestically and abroad.
3.2 Cooperation partners may specifically handle recruitment, language qualification, document preparation, or organizational support.
3.3 The selection of cooperation partners is carried out exclusively by CVC.
4. Requirements for Placement
4.1 In principle, Pflegefachkraf are placed who meet the respective professional and linguistic requirements for employment in Deutschland or who are currently in the recognition process.
4.2 CVC decides at its dutiful discretion on the admission of a candidate into the placement process.
5. Obligations of the Client
The client undertakes to provide all information required for the placement in full,
- conduct job interviews promptly,
- submit necessary documents on time,
- comply with all statutory labor and residency regulations.
6. Remuneration
6.1 Remuneration is based exclusively on the respective placement contract.
6.2 All prices are subject to the applicable statutory value-added tax.
6.3 Invoices are due for payment without deduction within ten days of the invoice date.
7. Employer Pays Principle
7.1 Remuneration for the placement services is paid exclusively by the respective client.
7.2 CVC does not charge any placement fees to the placed Pflegefachkraf.
7.3 Before the placement begins, applicants may independently bear costs for language qualifications or other preparatory measures at independent educational institutions or cooperation partners.
7.4 If an agreement exists between CVC and a Pflegefachkraf regarding the reimbursement of certain training costs, this shall be carried out exclusively in accordance with the individually agreed conditions.
8. Data Protection and Confidentiality
8.1 Both contracting parties undertake to treat all personal data and application documents confidentially.
8.2 Personal data is processed exclusively in accordance with the provisions of the General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG).
8.3 Application documents may be used exclusively for the purpose of personnel placement.
9. Liability
9.1 CVC is liable without limitation for intent and gross negligence.
9.2 In cases of simple negligence, CVC is liable only in the event of a breach of material contractual obligations. Liability is limited to the foreseeable damage typical for the contract.
9.3 The limitation of liability does not apply in the event of damage to life, body, or health, or insofar as mandatory statutory provisions conflict.
10. Contract Duration and Termination
10.1 The contract term and notice periods for termination result from the respective placement contract.
10.2 Any remuneration claims already incurred remain unaffected by termination.
11. Force Majeure
CVC is not liable for delays or obstacles to performance due to force majeure, in particular official measures, natural disasters, pandemics, war, strikes, or other unforeseeable events.
12. Final Provisions
12.1 Amendments or supplements to these GTC must be made in text form.
12.2 Should individual provisions be or become invalid, the validity of the remaining provisions shall remain unaffected.
12.3 The law of the Federal Republic of Germany shall apply.
12.4 Place of jurisdiction is – insofar as legally permissible – the registered office of CVC.
